PALMDALE, CA, AUGUST 9, 2011 – On August 9, 2011, the Second District Court of Appeal issued its decision reversing the decision of the trial court upholding the water budget rate structure established by Palmdale Water District.
The water district was disappointed with the Court of Appeal’s decision. The water district’s General Manager, Dennis LaMoreaux, stated, “We believe the court was wrong in concluding that our rate setting process did not meet all legal requirements. The court’s decision has the potential to harm the long term interest of Palmdale and disrupt the water conservation policies so essential to our desert community. Consequently, the District will be considering all options available to it concerning the court’s decision, including seeking review by the California Supreme Court.”
